Terms of Use

Effective date: October 18, 2026

These Terms of Use (“Terms”) are an agreement between you and Echad Software, LLC (“Echad Software,” “we,” “us,” “our”). They cover our apps, DispatchR Base Ops, DispatchD, and PostSchedulR (each an “App”), and this website, echadsoftware.com. By downloading or using an App or the website, you agree to these Terms. If you use an App for a business, you agree to them for that business and confirm you are allowed to do so. If you don’t agree, don’t use the Apps or the website.

How we handle information is described in our Privacy Policies: https://echadsoftware.com/privacy-policy/

1. Your license to use the Apps

We give you a personal, non-exclusive, non-transferable, revocable license to use each App on Apple devices you own or control, as allowed by Apple’s App Store Usage Rules. You may not copy, modify, resell, rent, or distribute an App, take it apart or try to recreate its source code (except where the law allows this anyway), get around its purchase or access controls, or use it to build a competing product. The Apps, their design, and our names and logos belong to Echad Software, LLC.

2. Services you connect

The Apps work with services you choose to connect, such as Apple iCloud, Square, Stripe, PayPal, Meta (Facebook, Instagram, and Threads), Google (including Google Ads, Business Profile, and YouTube), Microsoft Advertising, LinkedIn, Bluesky, Mastodon, Pinterest, Canva, PostGrid, Lob, Mailchimp, Brevo, Twilio, Housecall Pro, Gelato, and AI apps on your device. Those services are run by other companies under their own terms and privacy policies, which you are responsible for following. We don’t control them and aren’t responsible for their availability, changes, decisions (such as rejecting a post or ad, or suspending an account), or fees. Anything they charge, including ad spend, postage, printing, messages, and payment processing fees, is billed to your account with them, not by us. When a service changes or withdraws what it offers to apps, a feature that depends on it may stop working.

YouTube: PostSchedulR’s YouTube features (uploading a video to your YouTube channel as a Short or for a YouTube ad, and reading your channel’s name) use YouTube API Services. By using them, you agree to be bound by the YouTube Terms of Service at https://www.youtube.com/t/terms. Google’s Privacy Policy at https://policies.google.com/privacy describes how Google handles data, and you can remove PostSchedulR’s access to your YouTube channel at any time at https://security.google.com/settings/security/permissions.

3. Your content and your data

You keep all rights to what you create or bring into the Apps, such as posts, photos, designs, ads, customer records, estimates, and invoices. You are responsible for it, and you confirm that you have the right to use and publish it, including images, designs, logos, and music you didn’t create yourself. Your data stays on your devices, in your own iCloud account, and with the services you connect, as our Privacy Policies describe; we don’t receive a copy and claim no rights to it. Keep your own backups: we can’t restore data we never had.

4. Your customers and the messages you send

When you use an App to contact your customers or store their information, you are responsible for doing so lawfully, including:

  • getting the consent the law requires before sending marketing text messages (for example under the U.S. Telephone Consumer Protection Act), completing any carrier registration your text provider requires (such as A2P 10DLC in the U.S.), and honoring opt-out requests;
  • following email marketing laws (such as the U.S. CAN-SPAM Act), including a working unsubscribe link and your business’s postal address, and honoring unsubscribes;
  • following the rules for direct mail and any lists you use;
  • following privacy laws that apply to your customers’ information, keeping it accurate, and answering their requests to see, correct, or delete it, since your business controls those records;
  • following the rules of the card networks and payment processors when you take payments.

5. Ads and spending

Ads, budgets, and changes are made in your own ad accounts, and the ad platforms charge you for them under their terms. Review every ad, budget, schedule, and change before you approve it. Suggestions from an App or a connected AI app are only suggestions: we don’t guarantee any result, cost, reach, or return, and we aren’t responsible for money spent through your ad accounts, for an ad platform’s decisions, or for results that don’t meet your expectations. Results and reports in the Apps come from the platforms and services and may be delayed, estimated, or incomplete.

6. AI features

If you connect an AI app, it is a separate product governed by its maker’s terms. AI output can be wrong, incomplete, or inappropriate. Read anything an AI app writes or proposes before you publish, send, or approve it; you are responsible for what goes out under your name.

7. Payments, records, and reports

Payments you take in DispatchR Base Ops or DispatchD are processed by the payment provider you connect, under its terms; we never receive or hold the money, and disputes, refunds, and chargebacks are between you, your customer, and that provider. Estimates, invoices, tax amounts, reports, and exported files (such as bank-statement files for accounting software) are tools to help you; they are not tax, accounting, or legal advice. Check them, and talk to a professional for advice about your business.

8. Purchases, subscriptions, and trials

Paid features, subscriptions, and free trials are sold through Apple’s App Store and are governed by Apple’s terms. Apple handles billing, renewals, cancellations, and refunds; manage them in your Apple account settings. Prices and what is included may change for future purchases or renewal periods, as the App Store allows.

9. Acceptable use

Don’t use the Apps or the website to:

  • send spam or messages, ads, or posts that are unlawful, deceptive, harassing, hateful, or that infringe someone else’s rights;
  • break the rules of a service you connect, or use an App to get around its limits or protections;
  • upload malware, or try to break into, overload, or misuse the Apps, the website, or the services that support them, including our sign-in and image-hosting service on Cloudflare, which may be used only by the Apps for their intended purposes;
  • collect or use other people’s information without a lawful basis.

We may limit or stop access to our online services for anyone who misuses them.

10. Changes and availability

We may update, change, or stop offering an App or any feature, for example to keep up with changes at Apple or a connected service. We try to keep the Apps working well, but we don’t promise they will always be available, uninterrupted, or free of errors.

11. No warranties

TO THE FULLEST EXTENT THE LAW ALLOWS, THE APPS AND THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some places don’t allow some of these exclusions, so they may not all apply to you.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, ECHAD SOFTWARE, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR AD SPEND, FEES, OR CHARGES FROM SERVICES YOU CONNECT, ARISING FROM YOUR USE OF THE APPS OR THE WEBSITE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE APP INVOLVED IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50. Some places don’t allow these limits, so they may not all apply to you.

13. Indemnity

If someone makes a claim against Echad Software, LLC because of your content, the messages, mailings, or ads you send, how you handle your customers’ information, or your breaking these Terms or the law, you agree to cover the reasonable costs, including legal fees, that result.

14. Ending these Terms

You can stop using an App at any time by deleting it. These Terms end automatically if you break them. Sections 3 through 7 and 11 through 17 continue after these Terms end.

15. Apple App Store terms

If you got an App from Apple’s App Store:

  • These Terms are between you and Echad Software, LLC, not Apple. Echad Software, LLC, not Apple, is responsible for the App and its content.
  • Your license is limited to using the App on Apple-branded products you own or control, as allowed by the App Store Usage Rules.
  • Apple has no obligation to provide maintenance or support for the App.
  • If the App fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the App, and any other claims, losses, or costs from a failure to meet a warranty are Echad Software, LLC’s responsibility to the extent these Terms don’t exclude them.
  • Echad Software, LLC, not Apple, is responsible for addressing any claims about the App or your use of it, including product liability claims, claims that the App doesn’t meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
  • If anyone claims the App or your use of it infringes their intellectual property, Echad Software, LLC, not Apple, is responsible for investigating, defending, settling, and resolving the claim.
  • You confirm that you are not in a country subject to a U.S. Government embargo or designated as supporting terrorism, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must follow the terms of any other service you use with the App, such as your carrier or the services described in Section 2.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

16. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state courts located in Sheridan County, Wyoming, or the United States District Court for the District of Wyoming, and you and we agree to their jurisdiction, unless the law where you live gives you the right to bring a claim where you live.

17. Changes to these Terms

We may update these Terms. We’ll change the effective date above and, for important changes, give notice in the Apps, their App Store listings, or on this website. If you keep using an App or the website after an update, you accept the updated Terms. If any part of these Terms can’t be enforced, the rest still applies. Not enforcing a part of these Terms doesn’t mean we’ve given up the right to.
